The Court has a varied jurisdiction in which it hears and decides cases arising under Criminal Law Statutes, the Village Code, Vehicle and Traffic laws and other New York State laws. The Court is in session every Monday, at 9:30 am (except for holidays). The Court also hears and determines Civil Claims, Landlord/Tenant disputes (residential and commercial) and Small Claims.
Civil matters, including Small Claims proceedings, are calendared in a manner which is convenient to the litigants while taking
into consideration the Court's caseload. Please call in advance to ascertain a court date prior to filing a case.

The monetary limit of the Court's jurisdiction is $3,000.00 (with the exception that a case may be filed with the Westchester County Court in which it could be transferred to Irvington, if jurisdiction permits, with an increased limit up to $5,000.00), except
in the area of Landlord/Tenant matters. Consideration must also be given to the residence or business address of the parties
being that there are territorial requirements which must be met. The Court Clerk is prepared to answer questions regarding the Court's jurisdiction and procedures and she is ready to assist litigants in filing and processing their claims. The Court Clerk is available from Monday to Thursday during the hours of 9:00 am until 4:00 pm.

Criminal matters are prosecuted by the Westchester County District Attorney's Office or the Village Prosecutor. Depending upon the level of offense charged, an individual accused of a higher level offense may be entitled to a Jury Trial. All criminal litigants are entitled to be represented by an attorney. If an attorney cannot be afforded, one will be appointed by the Court to represent the individual's interests, and the expenses of this representation will be paid by the County of Westchester upon judicial determination.

As the Court closest to the people, the Irvington Justice Court assures that each individual's case will be handled in an efficient, sensible and professional manner to ensure that justice has been served.
